This book was developed by Yayasan Swadaya Dian Khatulistiwa (YSDK) based on its advocacy and community assistance experience in resolving transmigration land cases in West Kalimantan, particularly in Kubu Raya Regency. The publication documents the field-based processes undertaken, including the dynamics, challenges, and key lessons learned in facilitating the resolution of transmigration land certification.
One of the primary issues in transmigration land cases is the unresolved or disputed status of land ownership. This situation often delays the issuance of land certificates and triggers prolonged conflicts among local communities, transmigrant settlers, and other interested parties. In many instances, the disputes persist even after undergoing judicial proceedings.
Drawing on this experience, YSDK developed an alternative approach in the form of a “peaceful solution” through non-litigation mechanisms. This approach emphasizes dialogue, informal consultations, and the strengthening of multi-stakeholder collaboration to identify mutually acceptable solutions. The process is carried out gradually, prioritizing trust-building and the creation of constructive communication spaces among parties who were previously in opposition.
In practice, YSDK consistently applies an action–reflection approach. Each step undertaken is collectively reviewed and evaluated, serving as a learning process to inform subsequent strategies. This enables the land resolution process to remain adaptive and context-sensitive, in alignment with the specific conditions and needs of the local communities.
